STATUS ON REFUGEES IN TAMIL NADU

Vaiko, Leader of MDMK  in Tamil Nadu State, India was arrested and released in the evening as usual, when he protested against Eelam Tamils being held in detention illegally in a Special Camp in Poonthamalli.  There is another Special Camp in Chenkalpattu and many other Refugee camps in Tamil Nadu. TheTamil refugees in Tamil Nadu are living  under very bad conditions whether it be the DMK or ADMK rule. In contrast the Tibetean Refugees are leading a very confortable life in India with all the privileges. This is happening when there are large number of Ministers   from Tamil Nadu in the Central Government in Delhi. There are very powerful Ministers like P.Chithamparam . Whilst the Tamil Ministers in central Government are ineffective in even safeguarding the Tamil Nadu Fishermen from Rameswaram. Dhanuskodi and other Tamil Nadu Coastal areas  who are being beaten up and sometimes killed in the Palk Strait between India and Sri Lanka, by the Sri Lanka Navy. Central Government Ministers from Kerala State are up in arms even if two Malayaalee fishermen are killed by the Italians. This they do even when the all powerful Leader and the 'de facto' ruler of the largest democracy in the world 'India' is said to be an Italian. This shows how weak and ineffective are the politicians and 70 Million Tamils   in Tamil Nadu.It is time that they realise that Fasting for few hours or repeating the same slogans for few hours are not effective enough to bring about results.

Although India is the largest democracy in the World it has not yet signed the Convention relating to Refugees of 1951. This Convention came into force on April 22,1954. As of June 15, 2000, the convention had 136  State Parties.Office of the United Nations High Commissioner for Refugees(UNHCR) came into existence on January 1, 1951 and was initially set up for a period of three years. The work of the UNHCR is humanitarian, social and non-political. UNHCR promotes standards of treatment of Refugees that accrued with basic human rights standards. Standards like the 'Sphere standards' stipulates the minimum dimensions of the shelter provided, Quantity of drinking water made avaiable per person etc. in IDP/Refugee camps. Human rights defenders and activists and Tamil political parties should insist upon the Indian government  to sign the Refugees Convention, without being inert.  This will give access to UNHCR to assist the refugees and maintain minimal standards necessary in the camps.

SRI LANKAN SITUATION

The following News Item with comments datelined 19-20,August, 2012 tells us of the pathetic Law and Order order situation in Sri Lanka.Comments from Sri Lankans on this news item especially that of ,Renuka Amarasinghe (a lady), Nodrog and V.Andrew are of serious concern.

Whilst the real situation in Sri Lanka is desperate, it is ridiculous to hear from the Sri Lanka diaspora members who travel to Sri Lanka and spend only a few days there claiming that all is fine there.

It is sugested that a similar Travel Advisory be issued by the Norwegian Authorities to safeguard the gullible Tamil Norwegians and others intending to travel to Sri Lanka.

SL to challenge British travel advisory

E-mail Print
Sri Lanka today said it will challenge the latest UK travel advisory to British citizens warning them of an upsurge of nationalism, sexual offences and anti-western rhetoric in the country.

The external affairs ministry said that the matter will be taken up with the British authorities and enquiries would be lodged in the country as well as in London.

"We will seek information as to how they had come into conclusions which had led to the issuance of the travel advisory concerned," a senior official of the public communication division in the ministry said.

The travel advisory however claims that violent crimes against foreigners are not frequent but seeks to warn resident Britons to be careful on the move.

Britons were asked to carry alarms as there was a steep increase in rape and sexual molestation cases.

Earlier, a British tourist was killed last Christmas in a southern resort while his girl friend was assaulted. A local ruling party politician is under arrest for the murder.

After Indian tourists, the UK is the second single largest inbound travel market for Sri Lanka.

Tourism infrastructure development is a key area of the island's economic development since the war with the LTTE ended three years ago. (PTI)

Unfortunately, a travel advisory has to be issued to our mothers, sisters and daughters. Our country is not a safe place for them to travel alone. It won´t be long before our grand mothers also will not be safe. God bless Sri Lanka.

For Gods sake a British citizen has been murdered and his girl friend raped by a govt politician ,and the suspected murderer sacked and re admitted to the ruling party. The rule of law and crimes against tourists especialy females has been escalating.,Murders ,rapes kidnappings are now a common occurence. The police are a helpless corrupt lot.. This not a safe tourist paradise anymore

Instead of wasting time and energy protesting first get your house in order and stop the killings and rape of our women and children. If our own nationals are not safe here how foreigners feel safe?

SOUTH AFRICAN EFFORT AND SRI LANKA

Negotiations had been going on for a long time between the Tamil National Alliance(TNA), the party with the highest number of Tamil M.Ps in the parliament of Sri Lanka and what was said to be the government delegation for a long time. TNA had given in writing many cogent reasons as to why they can't go back to the negotiating table. They are not prepared to join the All party parliamentary commitee as well due to the past experiece.Even Mr.Godage, a very  experienced former Diplomat and current High Commissioner to Malaysia has talked about the number of  round Table Conferences, commissions, committees which were not succesful in solving the  Sri Lanan National problem. He is to be called back to Sri Lanka for saying so by the SL foreign ministry. There is a deadlock now in the post war conflict resolution situation. South Africa is a country which was successful in solving its own national problem succesfully. If we can not solve a problem ourselves there is no shame in getting others to help us. It happens all the time. If there is a problem between two brothers an Uncle helps. Likewise when there is a problem between a husband and wife common friends help and often it works especially in the Asian context.

Sri Lanka Government  or the Sinhala people may not be trusting the western countries thinking that they may have some hidden agenda. But what is the objection one could have against a neutral country like SA offering with all good intention their services. Messes,Ebrahim and Meyer who were in the delegation that offered to help SL, are not Tamils either. One has to accept the fact that Mr.Pieris or Mr.Samarasinghe have no expertise or experience in succesful Conflict Resolution however good they may be in making speeches. We saw that in Geneva only reccently. In the interest of the country we have to seek expert assistance. So is the President .He is no Mandela.   APC may not convene forever and even if it does convene with so  many parties pulling in so many directions and that too without an expert to guide them they will never arrive at a consensus. That in all probability may be the idea behind convening it in the first place.

The Tamil diaspora has a genuine interest in the SL National problem being solved. As of now although they are sending a large amount of money to their kith and kin  back home, their kith and kin are still suffering. They shoual have an equal right if not more than dual citizenship holders like the Defence Secretary , Gotapaya and Basil, the Development(?) Minister(Sri Lanka and US citizens). If they are real patriots they should renounce their US citizenship and help even if another person like Ranil or Premadasa or Chandrika and not their brother becomes the President. Of course they will not have to assist a Tamil or a Muslim as they have no chance at all unlike in India of becoming a President in Sri Lanka.

One has to be careful of spoilers like Dr.Gunadasa Amarasekere who is not ready to allow even the13th Amendment to the Constitution being implemented. 13th amendment does not permit the Health Minister to appoint even a labourer to the Hospital in his province without the consent of the Provincial Governor who is the representative of the all powerful Executive President of the country under a unitary constitution.

13th AMENDMENT TO THE SRI LANKA CONSTITUTION AND RIGHT TO SELF DETERMINATION

Dr.Dayan Jayatilleke(DJ) states that both the Sinhalese and Tamil sides are uncommitted to / ambivalent about the existing attempt (of external provenance)at a constitutional bridging formula-13A.

13A is nothing but rule by the all powerful Executive President under a unitary constitution through his representative Governor. When it comes to North/East the Governor is often an Ex Armed Forces Officer.Hisbullah when he was a Minister in the Eastern Provincial Council in charge of Health said even to appoint a labourer in the Hospital you need the Governor's permission (who incidentally was an Ex Navy man). The President could dissolve the Provincial Council.

Even in its formative period Amirthalingam,Sampanthan and Sivasithamparam pointed out (incidentally)13 flaws in the 13A and wanted JR to improve on it in the presence of Natwar Singh, then State Minister of Foreign Affairs in the Indian Government and Kuldip Sahadev, the Joint Secretary in the same Ministry in Delhi. They said they (meaning Indian Government) had a firm commitment from J.R.Jayawardene, the then President of Sri Lanka to make those improvements to 13A as drafted. But the 20th Century Fox he was he tabled it before the Parliament as it was and even that remains unimplemented for over 25 years. How could it then be a starting point. Are the people(s) of Northeast wait for another 25 years to start all over again, like three years after Mullivaikkal still waiting for the Recommendations of the Lessons Learnt and Reconciliation Commission (LLRC)  established by the very same government to be implemented (and it has nothing new to offer).

On the question of 'Self determination', Article 1 of both ICCPR and ICESCof the United Nations(UN) and Article 55 of the UN Charter which speaks about respect for the principle of equal rights andthe right to  self determination of peoples.

Right to Self Determination relating only to former colonies is over long ago. By the Declaration on Friendly Relations and Co-operation among States of 1970 and the Helsinki Accord of August 1,1975 it has been elaborated and currently even within a Unitary form of Constitution in a Sovereign State if section of the people are continuously oppressed and have no meaningful access to government (as in the case of Sri Lanka), they have the right to self determination.

6th Amendment to the Sri Lanka Constitution  is bad law as it goes against the UN Covenants, UN Charter and Case Law Precedents. Whether Separation is bad or good even prohibiting one from airing his views can't be good law.

Canadian Supreme Court Decision with regard to secession of Quebec from Canada (1998) 2SCR 217-Judgment dtd 29th August, 1998  could not be taken as liberal just because France is far away from Canada as DJ puts it.Surely he should know that Judgments does not depend on distances between countries but on facts and law.

MARIYADAS DILRUKSHAN

Yet another political prisoner, namely Dilrukshan Mariyadas, 34 years old, from Jaffna in the Northern Sri Lanka has died last night at Ragama Teaching Hospital having not come out of the coma stage. He is one of the three others who were in critical condition along with Ganesan Nimalaruban said to be due to the beating and torture they received at the hands of the Prison Officers both in Vavuniya and Anuradhapura Prisons.

His father has stated that he came to know about his son being admitted to the Hospital at Ragama only from the newspapers. He has found severe injuries on his body when he saw him in the hospital.

GANESAN NIMALARUBAN

Nimalaruban 28 years old was born in Karainagar and was living with his parents in Nellukulam in Vavuniya. He was the only child of his parents and his parents were blessed with him after twelve years of marriage. He was arrested about eight months ago alleged by police to have had contacts with theLiberation Tigers of Tamil Eelam(ltte). He was held in Vavuniya Prisons along with many other Tamil political prisoners. His parents strongly deny that their son had anything to do with ltte. As it happens in the case of most of the political prisoners he was not indicted before a court of Law  but was being held in the Prison.Since three other prisoners (detainees) who were with them were to be removed to another Prison in the South of the Country a Protest was staged by the others against. it. It is said that they held three Prison Guards hostage. Special Task Forceof the PoliceSTF) has been  brought in to free them.

After that all the Tamil political prisoners have been mercilessly beaten and all of them have been removed to Anuradhapura Prison in the predominantly Sinhala area and yet again to Mahara Prisons near capital Colombo. It is alleged that they were again beaten up and tortured both in Anuradhapura and Mahara Prisons. Many have been seriouly injured and Nimalaruban died on  4t July on being admitted to Ragama Hospital. Three others are said to be in critical condition. Tortre of suspects under detention in Prisons is not new in Sri Lanka. Under the Emergency Regulations(EMR) and Prevention of Terrorism Act(PTA) 'confession' was admissible in evidence in Courts whereas under the normal Laws it was not. Often to extract confessions from suspects especially those Tamil Youths who were rounded up under suspicion were tortured to extract confessions. United Nations Human Rights Council appointed Rapporteurs and Special Representatives have commented on this in their reports in the past.

Parents of Nimalaruban were forced by Ragama Police to sign a  form filled in Sinhala which is suspected to have stated that he was a member of ltte if the body of their son was to be released to them. Such pressure was brought upon the parents of the five students said to have been murdered by the STF.They had refused to sign. The Ragama Magistrate has ordered that the body should be buried there and should not be taken to his home town as there may be breach of peace. Nimalaruban's parents had to petition the Supreme Court to reverse the order of the Magistrate and take the body to Vavyniya their home town. It was allowed after much deliberation with conditions attached. Whenever a person is killed, especially if it is a Tamil, the Police take the body to the mortuary at the Hospital in the area and they think with that their duty is over. Seldom a suspect is produced in Court for the killing afterproper  investigations are conducted. In the case of the Trinco five or the 17 Humanitarian workers(16 Tamils and 1 Muslim) belonging to Action Against Hunger,  the French NGO who were killed in Muthur in Trincomalee aleegedly by the Sri Lanka Army according to the then Head Of Mission of Sri Lanka Monitoring Mission (SLMM), Gen.Erik Henriksen, of Sweden no accused has been produced in Court to-date.In fact when the then Mutur Magistrate and current Jaffna Magistrate Manikkavasagar Ganesarajah has finished the Inquest into their death and was about to give the verdict he was ordered by the higher officials in Colombo to transfer the case file immediately to the Anuradhapura Magistrate who happened to be a Sinhalese.

It would seem from the actions of the judiciary and Police in Sri Lanka more attention is focussed in protecting the accused than finding him and producing him before the Courts. The Police and Army often prevent the mourners from visiting the house of the demised person. They prevent the people from putting up black flags showing their sadness as is traditional among the Tamils. In the case of the five students killed on the beach in Trincomalee also same thing happened. It was during the period, the Cease Fire Agreement (CFA) brokered by the Royal Norwegian Government was in Force and the Sri Lanka Monitoring Mission Head in Trincomalee had to tell the Poloice that they should not pull down the Black Flags or prevent the mourners from going to the house of the victims.

It is common sense that if an inmate of a Prison or a suspect inside the cell in a police station is dead it is the prison officials or the Officer in Charge of the particular police station who is responsible. In fact Justice Hector Seneviratne Yapa has also delivered  a judgement  to that effect.

It would seem that in the circumstances Law and Order and Justice are the ultimate victims in Sri Lanka.

BLACK JULY '83

'whereas it is essential that if man is not to be compelled to have recourse, as a last  resort to rebellion, against tyranny and oppression, the human rights should be protected by the rule of law'-Preamble to the Universal Declaration of Human Rights'(UDHR)

Article 3 of UDHR-states,'Everyone has the right to life, liberty and security of person'

Although Massacres of Tamils in Ceylon(now Sri Lanka) started from 1956-Igniyagala Massacre 05.june,1956 (Massacres of Tamils-1956-2008-Northeast Secretariat on Human Rights-NESOHR,2009-Chennai, 1958 Pogrom,Tamil Research Conference Massacre-10 January,1974, 1977 Communal Pogrom,1981 Communal Pogrom (Ibid), 1983 Pogrom against Tamils often referred to as Black July'83 was the worst that was directed against the Tamil Professionals, liberation fighters and Business Community. Just as in 01 June 1981, Burning of the Jaffna Library with 97000 rare books and Manuscripts by the Sinhala Police instigated by the then U.N.P. Ministers Cyril Mathew and Gamini Dissanayake was a cultural genocide. These very same persons were accused as the main culprits behind the 1983 pogrom against the Tamils.

While Dr.Rajasundaram of Ghandhiyam Movement, Vavuniya who pleaded with the murderers to spare their lives, the political prisoners of the Welikade Prisons and Liberation fighters Kuttimany, Thangathurai,Jegan,Thevan and others numbering 35 were killed on 25 July 1983 and a further 17 Tamil Prisoners were killed on 27 July,1983, by the Sinhala prisoners in the presence of the Prison Guards and other Officials.

Badly hurt by the pogrom were some of the Islands most prominent Industrialists, K.Gunaratnam, A.Y.S.Gnanam, R.Maharajah and others. whose interests spanned from Textiles, Film Distribution,Transportation,Hardware and Cosmetics manufacture.

Just two weeks before the attacks on Tamil people and property, President J.R.Jayawardene was quoted by the London Telegraph of 11 July,1983 as saying," I am not worried about the opinion of the Tamil People. We can not think of them, not about their lives or  their opinion....really if I starve the Tamil people Sinhala people will be happy.Nothing was heard from the President for 5 days into the pogrom and when he appeared on Television it was to say," the attacks were not a product of generality of Sinhalese people"

According to Professor Stanley Thambiah (Sri Lanka-Ethnic Fratricide and the Dismantling of Democracy -The University of Chicago,1986, around 2000 Tamils were killed and the total economic loss has been placed at USD300 Million.According to him elsewhere in Trincomalee, the beautiful coveted Harbour on the East coast sailors from the Sri Lanka Navy ran amok  killing and looting and setting houses and shops on fire.

The REVIEW, a publication of the International Commission of Jurists(ICJ) said,"The evidence points clearly to the conclusion that the violence of the Sinhala riotors on the Tamils amounted to acts of GENOCIDE".(Emphasis attached)

According to N.Shanmugathasan, the General Secretary of the Ceylon Communist Party,"In Colombo at least 500 cars were set on fire with drivers and passengers inside the cars".-Black July'83:Indictment, -a history of race riots in Sri Lanka,London-April 2009.

A harrowing mass murder was witnessed by a Norwegian Tourist from Stavanger, Mrs.Eli Skarstein and her 15 years old daughter Kristen, as a mini bus full of Tamils was stopped by a Sinhala mob , petrol poured and the bus set on fire, after ensuring that the doors were locked. The eye witnesses reported that over 100 spectators watched as twenty Tamils were burned to death (Daily Express-London). Reports of this nature were many.

The New York Times of September 11,1983 quoted J.R.Jayawardene , the then President as saying,"I regret that some of my Party members have spoken in  the Parliament and outside words that encourage violence and the murders, rapes and arsons that have been committed."

Although the 1972 Constitution of Sri Lanka had 'Right to life' included, for some strange reason it was dropped from the current 1978 Constitution.
